As Chairman of the California High Speed Rail Authority, I say "yes."
Like the newscast noted, it sort of depends on how one might define the act of initial construction but the backers will find a way to turn a little dirt somewhere to validate the claim, even if it's only a few shovels' worth and not that many cubic yards of material.
