Was Judge Bruce Short right to have sent Barry Oake to jail?

    Whether you agree or disagree that the sentence fits the crime is one thing. However, when the prosecution (Crown representing the people) and defense agree on a facts and based their recommendation for sentence on that, precedent usually means that the judge will accept the agreement. The judge based his decision not on the agreement of the facts but on public opinion. The plea bargaining agreement process is common practice and it happens everyday and is one of the things that make the justice system run. Unfortunately, there are numerous people who have been found guilty of offenses such as these and the sentence that was agreed to by the prosecution and defense was similar to the agreement by the lawyers in this case. The judge let public opinion sway his decision and the appeal court overturned it. I find the offenses offensive as well, but, that is the justice system and the system is based to a large degree on precedent. People need to remember that there is right and wrong and then there is the justice system. Don't confuse the two. Much of this I don't agree with from a personal standpoint, but, that's the legal system we have.
