    It would seem to me that this man should not have had to eat through all the leaves of the artichoke before catching on that the leaves are inedible. It's hard to believe that he was even willing to swallow the first leaf. Makes me wonder if he even tried to chew it which should have tuned him in. An adult should know to ask when unsure of how to eat food he ordered. We're talking basic human common sense of which he seems to have none.

    assumption of the risk. plain and simple. It is not an abuse of the legal system as more inane cases have been brought before the court (and ruled on). This is a basis tort case where the defense will have to argue that the plaintiff should have known the inherent risks associated with eating an artichoke.

    I also voted that it was an abuse of the legal system. When you order a corn dog they don't tell you not to eat the stick! There are millions of other things you are served to eat that don't come with instructions - think of how annoying that would be.

    I voted other because I think it both an abuse of the legal system and stupidity on the man's part. Sure artichokes are tricky things, but if you don't know how to eat something using proper etiquette, don't order it.
