I think your question is misleading, "has your company ever challenged a Data Q ruling" this would infer that we had already challenged an inspection with an unsuccessful result and then challenged that ruling. We have been successful at challenging failed inspections but never successful at challenging a Data Q response not in our favor. I suspect that most responses really mean that the have challenged inspections with a Data Q and have been successful. You will almost never get them to overturn a Data Q decision. The DOT will never admit they are wrong twice for the same inspection.

Have successfully challenged 8 with 3 pending. Lost three but cannot win them all. It helps a lot when you first plea your case in court and win a dismissal of the charge. I have a 90% success in the courts so far. You have to do your research. You can no longer just know some of the CFR's. You have to know state administrative codes also.

We have never been susccessful in challenging a Data Q's ruling. That would mean there was an original posting, we did a Data Q and then challenged their findings. No have never had them change their mind after the original request. I find it hard to believe 56% have been susccessful.
