Since the software on the One is VERY adapted by HTC, the whole "but it doesn't have 4.2.2" is just meh. Perhaps it's BETTER than what Nexus 4 have? since Nexus 4 doesn't have Zoe and Blinkfeed and so on: does is then matter that it doesn't have 4.2.2 yet? Not very much. It STILL destroys Nexus 4. And as other said: you can change software..

Here we go, It's getting 4.2.2 shortly, they deliberately went with 4.1.2 as it's more stable, and in any case what does 4.2.2 REALLY give you that 4.1.2 doesn't..... Not a lot.
The One wipes the floor with the Nexus 4 in EVERY way, it's not even close.

The Nexus 4 has my vote. The One is probably an awesome phone, and probably the best phone built to date from all spectrums. But the phone is already outdated software wise. No phone is considered future proof but expected software updates (and timely) definitely helps. Your phone is only relevant in the market if it keeps making the software cuts, that's where the Nexus 4 takes the win, cost value also helps.
